Terms & conditions

The seller is referred to as CMS. The buyer is the customer, landlord, homeowner or managing agent.

  1. These conditions shall form part of every contract of sale entered into by CMS unless excluded or varied with written consent of CMS.
  2. In the event of the Buyer suffering any distress or execution to be levied against him or entering into any arrangement with his creditors or (being an individual) becoming subject to the bankruptcy laws or (being a company) entering into liquidation otherwise for the purpose of amalgamation or reconstruction or having a receiver appointed of the whole or any part of its assets, CMS shall be entitled to cancel the contract by notice in writing to the Buyer without prejudice to its rights to payment for goods delivered and for work undertaken and expenses incurred in connection with undelivered goods which shall become payable on demand.
  3. When booking an appointment the engineers visit must be paid for before the engineer is booked to call at the job address. This will be the day the job is booked on the system.
  4. Cancellation; a call can only be cancelled within office hours 9am-5pm Monday to Thursday. 9am-3:30pm Fridays. Cancellation on the same day of the dated appointment will not be refunded.
  5. The office will retain the payment details until the invoice is raised following the relevant job report being submitted to CMS accounts. At this point all payment details are destroyed.
  6. Prices; all CMS prices are subject to revision at any time in the event of any increase in costs caused by circumstance beyond the control of CMS, CMS reserve the right to charge such revised prices for goods affected by the increase.
  7. CMS cannot be held responsible for appliance modification by the manufacturer. The manufacturer reserves this right at all times.
  8. CMS cannot be held responsible for time lost at work by a given customer and no such claim will be refunded.
  9. FAILED ACCESS; CMS will not refund payment if the agreed access was not provided.
  10. CMS reserve the right to make a second charge if the engineer has failed to gain access at the time of the original appointment.
  11. CMS appointment times are to be used as a guide only and cannot be held responsible for delays relating to circumstances beyond their control.
  12. CMS cannot be held responsible for product failure.
  13. CMS reserve the right to charge for parking if this information was not disclosed at point of quotation for a given job address, this includes congestion charges also.
  14. CMS reserve the right to charge for warranty calls should the appointment become chargea ble in re lation to installer error upon the job report returning to the CMS accounts.
  15. CMS reserve the right to condemn a given installation if the site engineer finds a potentially dangerous situation.
  16. CMS are not accountable for consequential losses relating to the appliance.
  17. CMS cannot be held responsible for poor performance relating to previous system design.
  18. CMS are not an emergency service and cannot be expected to respond as such.
  19. CMS reserve the right to remove any engineer from its approved register with immediate effect.
  20. CMS cannot be sited for making nuisance marketing calls relating to the ann ual service required by the manufacturer submitted on the warranty cards by the developer, building contractor, engineer or homeowner as it is part of the service we provide to the manufacturer to protect the warranty lifetime guarantee for the end user.
  21. The manufacturer has the final judgement on any issue relating to the performance of a given cylinder.
  22. The manufacturer has the right to decline any claim against them.
  23. CMS are representing the manufacturer on a service industry basis only.
